Terms of Service

Acceptance

By accessing or using OpenHouse Follow Ups (“OpenHouse Follow Ups”, “we”, “us”), you agree to these Terms of Service. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization.

Service Description

OpenHouse Follow Ups provides tools to upload photos or PDFs of lead artifacts (such as open house sign-in sheets), extract structured leads, and help you draft and send follow-up emails. You are responsible for reviewing and approving any data or messages before you use them.

Eligibility & Accounts

  • You must be at least 18 years old to use the service.
  • You are responsible for maintaining the confidentiality of access links and devices used to access your account.
  • You agree to provide accurate information and to keep it reasonably up to date.

Your Content & Permissions

You retain ownership of the content you upload and the lead data you create (“Customer Content”). You grant us a limited, worldwide, non-exclusive license to host, store, reproduce, and process Customer Content solely to provide, secure, and improve the service.

You represent and warrant that you have all rights and permissions necessary to upload and process Customer Content, including any personal information it contains.

Emailing & Compliance

You are responsible for how you use the service to contact recipients. You agree that you will:

  • Only contact recipients where you have the required permission or lawful basis to do so.
  • Comply with applicable anti-spam and privacy laws (including CAN-SPAM, CASL, and similar laws).
  • Honor opt-out requests promptly and maintain your own suppression/do-not-contact list.
  • Not use the service to send spam, phishing, or otherwise deceptive or abusive messages.

Acceptable Use

  • Do not attempt to probe, scan, or test the vulnerability of the service or bypass security controls.
  • Do not interfere with or disrupt the service, including by overloading or abusing APIs.
  • Do not upload malware or content that is unlawful, infringing, or harmful.
  • Do not reverse engineer or copy the service except as permitted by law.

Paid Plans & Billing

If you purchase a paid plan, you agree to pay the fees and applicable taxes, and you authorize us (and our payment processor, Stripe) to charge your payment method. Plan features, pricing, and any refund policies (if offered) are described at checkout or in your account settings.

Availability & Changes

We aim to keep the service available, but we do not guarantee uninterrupted operation. We may change, suspend, or discontinue features at any time, including to maintain security, comply with law, or prevent abuse.

Intellectual Property

The service (including software, designs, and trademarks) is owned by Gulfhawk LLC and its licensors. These terms do not grant you any ownership rights in the service.

Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, express or implied. Extraction results and drafting assistance may be inaccurate; you are responsible for reviewing outputs before use.

Limitation of Liability

To the fullest extent permitted by law, OpenHouse Follow Ups and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim is limited to the amount you paid us for the service in the three months prior to the event giving rise to the claim.

Termination

You may stop using the service at any time. We may suspend or terminate access if we believe you violate these terms, create risk for other users, or use the service in a way that could cause harm or legal exposure.

Updates

We may update these terms from time to time. We will post the updated version here and update the effective date above. Continued use after changes become effective constitutes acceptance.
